What IS Covered (Accidental Damage)
The waiver covers accidental breakage or damage that happens while you are using the equipment responsibly and for its intended purpose.
Examples of covered damage:
- Bikes & E-Bikes: Punctured tubes (flat tires), snapped chains, broken pedals, bent spokes from normal trail/road use, and minor scrapes or scratches to the frame.
- Kayaks & Paddleboards: Minor hull scrapes or dings from submerged rocks, snapped ankle leashes, or cracked paddles from normal paddling pressure.
What is NOT Covered (Negligence, Theft, and Abuse)
This waiver is not insurance and does not cover theft, loss, or damage resulting from negligence, intentional abuse, or violation of the rental agreement. If damage is deemed to fall under these categories, the renter is responsible for the full cost of repair or replacement.
Examples of non-covered incidents:
- Unauthorized Users: The waiver is immediately void if you allow anyone else—who has not signed this rental agreement and waiver—to use the equipment.
- Theft or Loss: Leaving the equipment unattended, unlocked, or misplacing it. You are responsible for the equipment until it is returned to our staff.
- Gross Negligence & Abuse: Jumping bikes, doing tricks, crashing due to reckless riding, or riding under the influence of drugs or alcohol.
- Improper Transportation: Damage caused by improperly tying down watercraft to a vehicle, backing into a pole with bikes on a rack, or driving into a low clearance area with equipment on the roof.
- Water/Environmental Damage to E-Bikes: Submerging an e-bike in water, riding it through deep streams, or exposing the battery/motor to saltwater.
- Dragging Watercraft: Severe hull damage from dragging kayaks or paddleboards across asphalt, concrete, or sharp gravel instead of carrying them.
- Abandoned Equipment: Leaving the equipment on the side of the trail or river and failing to return it to the designated drop-off point.
Terms of Agreement
By declining this waiver, you acknowledge that you are financially responsible for any and all damage, repair, or replacement costs for the equipment up to its full retail value, regardless of fault. By purchasing this waiver, you are protected against accidental damage, subject to the exclusions listed above.
